As everyone knows, the Internet Corporation for Assigned Names and Numbers is the apex body responsible for the coordination and regulation of the Domain Name System namespace and Internet Protocol address space, protocol identifier assignment and root zone management for the root server system. On becoming an ICANN accredited registrar, a company must enter into an agreement for a specific period of time and should exercise its responsibilities and act in accordance with the agreement during its term as a registrar. In addition, ICANN gives license to use its logo on the registrar's website to signify its accreditation.

The ICANN can terminate an agreement with a registrar before its expiration under reasonable grounds. The procedure starts with the issue of a formal written notice thirty days in advance of the official termination. The following are the circumstances when ICANN can terminate the agreement with a registrar:

  • When the ICANN finds misrepresenting, incorrect or confusing facts in any material or document provided along with the registrar's application.
  • When a registrar is convicted of some financial crime, deception or breach of administrative duty, misuse of funds and other misdoings.
  • When a registrar's authorized personnel are convicted in financial crimes under the appropriate jurisdiction.
  • When a registrar operates in a manner that disturbs the operational integrity and stability of the Internet.
  • When a registrar becomes bankrupt.

Except under circumstances of bankruptcy and insolvency, ICANN allows the registrar to initiate litigation for deciding the aptness of the impending termination. For this, the registrar can obtain a stay of termination for an additional thirty days under the International Arbitration Rules of the American Arbitration Association (AAA).
